If it returns something other than rman located in $ORACLE_HOME/bin, then it's probably trying to execute the other rman executable because it appears first in your path.
To use RMAN, you can either provide the entire path or you can modify your path to ensure that the correct rman executable (in your ORACLE_HOME) is found first.
